IMPORTANT – Please read these Terms of Use carefully as they are a binding agreement between you and ThinkRisk Digital Technologies Private Limited (“ThinkRisk”).

ThinkRisk owns and operates the “thinkrisk.ai” and associated websites, By accessing, browsing or using any part of the ThinkRisk Websites, you accept these Terms of Use and agree to be bound by them.

If you do not agree with these Terms of Use, you may not use the ThinkRisk Websites.

 

Purpose of these Terms of Use

ThinkRisk has established these Terms of Use in order to:

  • Protect the integrity of the Thinkrisk Websites for all users of the Thinkrisk Websites;
  • Ensure the responsible use of the Thinkrisk Websites;
  • Protect Thinkrisk’s intellectual property.

General Use of the ThinkRisk Website

You are free to browse and use the Thinkrisk Website, and you may print or download content from the ThinkRisk Website, for your own personal, non-commercial use provided that:

  • You retain and keep intact all copyright, trademark, or other proprietary notice
  • You do not disseminate or distribute the content publicly or use it for any commercial gain; and
  • You abide by the terms and restrictions set out below.

Product Resources

  • User resources for Thinkrisk products, Such as help documentation, Case studies, tutorials, or other information (“Resources”), may be made available for access and use through the ThinkRisk Websites. You may access, use, and, where applicable, download the Resources for your own personal, non-commercial use provided that:
  • You retain and keep intact all copyright, trademark, or other proprietary notices contained in or on the Resources.
  • You do not use the Resources for any commercial gain.

You acknowledge and agree that:

  • Resources are provided solely for education about Thinkrisk products and services
  • Resources are provided “as is” without any warranty and are used at your own risk; ThinkRisk does not promise that Resources will be accurate or operate properly with Thinkrisk products; and
  • Resources may be varied or discontinued at any time.

Product Ideas

  • You may be able to submit ideas, suggestions, or feature requests (“Ideas”) through the ThinkRisk Websites. All Ideas you post or submit are owned by Thinkrisk and may be adopted by Thinkrisk for any of its products, services, or resources. You assign to Thinkrisk all right, title, and interest in and to all Ideas and you waive all rights you may have, now or in future, in respect of such Ideas, including all moral rights and the right to any compensation

    You acknowledge that:

    • Posting or submitting Ideas does not make you an author, inventor or contributing author or inventor of any Thinkrisk products, features or other works or inventions;
    • Thinkrisk has no obligation to accept or use any Ideas;
    • To the extent any Ideas are not assignable, you grant Thinkrisk a non-exclusive, royalty-free, worldwide, perpetual and irrevocable right and license to freely copy, use, make use of, publish, adapt, distribute, sell, license, create derivative works from and otherwise exploit your Ideas, including incorporating them into future versions of Thinkrisk products, services or resources.

Prohibited Conduct

In addition to the restrictions set out above, you must not use the ThinkRisk Websites in any inappropriate or unlawful manner. Examples of inappropriate and unlawful use include:

  • Distributing, selling, licensing, or otherwise commercially exploiting the Thinkrisk Websites or any materials, information, software, code or content posted or contained in them;
  • Harvesting or otherwise collecting information about others, including names and email addresses;
  • Probing, scanning, or testing the vulnerability of the Thinkrisk Websites, or breaching the security or authentication measures on the ThinkRisk Websites;
  • Using any device, software, or routine to interfere, or attempt to interfere, with the proper working of the Thinkrisk Websites or any transaction being conducted on the Thinkrisk Websites, or with any other person’s use of the Thinkrisk Websites;
  • Attempting to gain unauthorized access to Registered Areas of the Thinkrisk Websites or related systems or networks;
  • Using any robot, spider, scraper, deep link, or other automated data gathering or extraction tools, program, algorithm or methodology to access, acquire, copy or monitor any portion of the Thinkrisk Websites; and
  • Using or attempting to use any engine, software, tool, agent, or other device or mechanism (including without limitation browsers, spiders, robots, avatars, or intelligent agents) to navigate or search the Thinkrisk Websites, other than the search engines and search agents available other than generally available third-party web browsers (such as Microsoft Internet Explorer, Google Chrome, Mozilla Firefox or Apple Safari).

ThinkRisk reserves the right to suspend your use of the Thinkrisk Websites (including Thinkrisk products and Resources), or take other appropriate remedial action, to address any Prohibited Conduct or any violation or suspected violation of these Terms of Use.

Intellectual Property

The contents of the Thinkrisk Websites, and the materials made available through them, whether as text, multimedia clips, images, graphics, video, software, scripts, or in any other format, are protected by copyright, trademark, and other intellectual property laws.

Except as expressly set out in these Terms of Use, you may not copy, reproduce, republish, download, transmit, distribute or create derivative works from any of the content on any of the Thinkrisk Websites, without ThinkRisk’s prior written consent.

 

Users can transport or delete user’s data

User’s data is theirs. User can remove it anytime the user wants. When a user requests ThinkRisk Inc. to delete a user’s account for the Service, the user’s data will be permanently expunged from ThinkRisk. primary production servers and further access to the user’s account will not be possible. ThinkRisk. will also promptly disconnect any connection ThinkRisk. had established to the user’s Account Information and delete all account credentials. However, portions of the user’s data, consisting of aggregate data derived from the user’s Account Information, may remain on ThinkRisk. production servers indefinitely. User’s data may also remain on a backup server or media. ThinkRisk. keeps these backups to ensure ThinkRisk’s continued ability to provide the Service to users in the event of malfunction or damage to ThinkRisk’s primary production servers. ThinkRisk also reserves the right to use any aggregated or anonymous data derived from or incorporating user’s personal information.

Users are responsible for maintaining the confidentiality of their Login ID and Password

ThinkRisk maintains rules to help prevent others from guessing a user’s password. ThinkRisk also recommends that users change their password periodically. The user’s password must be at least 6 characters in length with a combination of alphabets and numbers. Users are responsible for maintaining the security of their Login ID and Password. User shall not provide these credentials to any third party. If the user believes that they have been stolen or been made known to others, the user must contact ThinkRisk immediately at Privacy@ thinkrisk.com, but in any event, the user should change the user’s password immediately via the Service. ThinkRisk will not be responsible if someone else accesses the user’s account through Registration Information they have obtained from the user or through a violation by the user of this Privacy and Security Policy or the www.thinkrisk.com Terms of Use.

If the user has a security-related concern, they may contact ThinkRisk at Privacy@thinkrisk.com. ThinkRisk will work closely with users to ensure a rapid and personal response to user’s concerns.

Updates to ThinkRisk Inc. Privacy and Security Policy

ThinkRisk Inc. will update this Privacy & Security Policy periodically. The date last revised would appear at the top of the Policy. Changes will take effect immediately upon posting.

Addressing user’s questions or concerns

Should users have questions, comments, concerns, or feedback regarding this Privacy and Security Policy or any other privacy or security concern, they may send an e-mail to privacy@thinkrisk.com

Enforcement

All ThinkRisk Inc. employees and authorized third parties (customers, vendors, etc.) are expected to comply with the policies and will be monitored by the IT department and the Information Security Team. Any violations to the policy reported or detected will result in the concerned employee/s or third parties being subjected to disciplinary action up to and including termination.

The ThinkRisk Websites may contain technical inaccuracies or typographical errors. Thinkrisk assumes no responsibility (and expressly disclaims responsibility) for updating the Thinkrisk Websites to keep information current or to ensure the accuracy or completeness of any posted information. Thinkrisk reserves the right to modify the content of the Thinkrisk Websites, or to suspend or terminate operation of or access to the Thinkrisk Websites, at any time for any reason.
